B3.7.1 Waste Framework Directive [2006/12/EC]

 

The full title is the Directive 2006/12/EC of the European Parliament and of the Council of 5 April 2006 on waste.

This Directive consolidated and replaced Directive 75/442/EEC (as subsequently amended). The aim of this was to clarify the legislation on waste, but it did not change the content of the applicable rules.

The Directive requires that Member States:

  • Prohibit the abandonment, dumping or uncontrolled disposal of waste
  • Promote waste prevention, recycling and processing for re-use.
  • Inform the Commission of any draft rules concerning the use of products which may cause technical difficulties and excessive disposal costs.
  • Ensure that waste is disposed of in compliance with the Directive.
  • Ensure that those who treat, store or tip waste on behalf of third parties obtain a permit from the competent authority.
  • Uphold the “polluter pays” principle by ensuring that the cost of disposing of waste is borne by the holder.
