B3.5.2.1 Directive Waste
The Waste Management Licensing Regulations 1994 [SI No. 1056] define Directive Waste as:
“any substance or object in the categories set out in Part II of Schedule 4 which the producer or the person in possession of it discards or intends or is required to discard but with the exception of anything excluded from the scope of the Directive by Article 2 of the Directive.”
Here, the Directive it is referring to is the Council Directive 75/442/EEC on waste. This has since been replaced by the codified version, which is the European Framework Directive [2006/12/EC].
This means that the UK regulations are agreeing with the definition of waste as laid out in the European Framework Directive on Waste.
