B5.9 Role of the Regulator

Contaminated Land is regulated by both the Local Authority and various Regulators. In England and Wales that is the Environment Agency (EA), in Scotland it is the Scottish Environmental Protection Agency (SEPA) and in Northern Ireland it is the Northern Ireland Environment Agency (NIEA).

The Environmental Regulator (EA, SEPA or NIEA) regulates the ‘Special Sites’.

The Local Authorities regulate all others areas of contaminated land, including remediation requirements in Planning Permission applications.
