B1.11.2 Nuisance

 

The law of nuisance was created to stop bothersome activities or conduct, when they unreasonably interfered either with the rights of private landowners or the general public (private and public nuisance respectively).

What is classed as unreasonable will depend on factors such as location and duration. For example, it is not unreasonable for your neighbour to have a crying baby in the house, however annoying it may be. It would be unreasonable for your neighbours to play loud music at 3am.

Statutory Nuisance

Under environmental law Statutory Nuisance is an offence. It may be caused for example, by excessive noise, smoke, dust or light.
